The Ministry of Economic Development Proposes not to Apply Penalties to Tenants for Early Termination of the Contract

The Ministry of Economic Development has prepared a draft decree which proposes not to apply penalties to tenants for early termination of the contract in cases where the issue is not directly settled by the contract. This was announced on May 6 by the Minister Maxim Reshetnikov at a meeting with the President of the Russian Federation Vladimir Putin on the implementation of previously taken measures to support the economy and the social sphere.

According to him, this initiative is aimed to protect the interests of small businesses and complements measures already taken by the Government to support entrepreneurs in terms of rent. They relate to the postponement of rental payments for use of state, municipal and private property in the context of the spread of coronavirus infection.

"The Federal Agency for State Property Management has already received 650 requests for the payments to be postponed. Such processes have also begun at private property facilities," the minister said. Currently, the Government has assumed the functions of a regulator for deferrals of private property lease payments and has granted the tenant the right to demand deferred payments in full for the quarantine period, and in half until October 1.

According to the minister, the regions have also prepared a regulatory framework for deferral of rental payments. 28,500 SMEs have already taken advantage thereof.
