According to the rules, boxes for collecting charitable donations can only be installed by non-profit organizations whose constituent documents provide for the right to charitable activities. The corresponding draft resolution was developed by the Ministry of Economic Development.
The box for collecting charitable donations can only be used for collecting funds for charitable activities (defined in article 2 of Federal law No. 113-FZ "On amendments to the Federal law "On charitable activities and volunteerism" dated April 7, 2020.
Among the mandatory requirements for boxes intended for collecting charitable donations are the following:
- A donation box is set under the agreement between the owner of the premises and a non-profit organization, except in cases where the premises where it is located are owned or used by such an organization, or the organization holds an event where it is located.
- The donation collection box must be assigned an inventory number, it must be equipped with information about the organization that collects donations (name, postal address, TIN, account number); it must specify the name of the program or other act in accordance with which donations will be collected; the domain name and/or network address of the official website of the organization (if available); contact details for which the benefactor can get information. The box must be sealed with a paper tape with the organization's signature and seal, or with a numbered seal.
The draft resolution suggests that a portable box for collecting donations can be moved by a volunteer or an employee of the organization who has a power of attorney or an agreement with the organization. Information about the installed donation box with the box's installation address is posted by the organization within 3 working days on its official website (if available).
A stationary box for collecting charitable donations should be installed in such a way that the possibility of moving it for outsiders is as limited as possible.
The rules are established both for collecting money and other property for charitable purposes.
The draft resolution also establishes the rules for the extraction of property collected with the box for collecting charitable donations.
According to the Deputy Minister of economic development of the Russian Federation Tatyana Ilyushnikova, "the draft resolution is aimed at excluding fraudulent actions in collecting charitable donations and increasing public confidence in charitable organizations." "Its adoption will expand opportunities for charitable activities," the Deputy Head of the Department stressed.
