The Ministry of Economic Development proposes to extend the moratorium on scheduled inspections of small businesses until the end of 2021

The relevant provisions are contained in the draft accompanying law, developed by the Ministry of Economic Development to Federal law No. 248-FZ "On state control (supervision) and municipal control in the Russian Federation". The document provides for the extension of the moratorium for small businesses for the whole 2021. 

"In March of this year, the Government announced a moratorium on scheduled inspections, in addition, the grounds for unscheduled inspections were significantly limited. Due to this, the amount of control and supervision activities have significantly decreased: in the first half of 2020, 46% fewer inspections have been conducted than in the same period of 2019. In the first months of the moratorium, the number of inspections have reached a historic low. Now we see a stabilization of the situation. Next year, we plan to support business in the logic of previously adopted decisions of the Government, " State Secretary – Deputy Minister of economic development Alexey Khersontsev said.
 
In addition, the draft accompanying law introduces amendments to more than 100 sectoral laws on types of control (supervision). These include Federal law No. 52-FZ "On sanitary and epidemiological welfare of the population", Federal law No. 69-FZ "On fire safety", Federal law No. 273-FZ "On education in the Russian Federation", Federal law No. 196-FZ "On road safety" and many other laws regulating the implementation of certain types of control (supervision).
 
Amendments to them fix the name of the type of control (supervision) and determine the level of public authority at which it is carried out (federal, regional and municipal). The subject of control is also set. This is necessary to ensure that the provisions of industry laws comply with law No. 248-FZ, which comes into force on July 1, 2021. According to Alexey Khersontsev, the accompanying law lays the foundation for further regulation of types of control (supervision). "On the basis of the accompanying law and the changes that are being made to industry laws on types of control, regulations on types of control will be further prepared. In total, more than 200 such regulations will be prepared. These are the key documents that will guide the inspectors when conducting control and supervisory activities, " the Deputy head of the Ministry of Economic Development said.
 
In addition to the norms in the field of control (supervision), the draft accompanying law also simplifies licensing procedures provided for by Federal law No. 99-FZ "On licensing of certain types of activities". The latter applies to 52 types of licensing. The most widespread of them are educational activities (120 thousand licenses), medical activities (103.5 thousand licenses), passenger transportation by road (64.8 thousand licenses) and pharmaceutical activities (55.4 thousand licenses).

In particular, it is planned to reduce the time for issuing licenses to 15-30 working days for certain types of licensing (their list will be approved by the Government).

It is possible to suspend the license not in full, but in part if the supervisory authority detects violations in the performance of certain works and services that make up the licensed type of activity. Also, if when granting a license, it is revealed that the license applicant does not meet the license requirements for a part of the works and services claimed by him, a license is provided for those works and services for which no inconsistencies were detected.

Finally, in the development of the transition to a registry model in the field of licensing, it is planned to optimize the document flow of licensing authorities. "All decisions and licensing cases made by the licensed body are fully translated into electronic format. This will significantly reduce document flow and speed up decision-making. We are talking about more than 600 thousand licenses," Alexey Khersontsev said.
