The relevant provisions are stipulated by the draft amendments to Federal law No. 99-FZ "On licensing of certain types of activities" dated May 4, 2011, which the Ministry of Economic Development has submitted to the Government. The document was prepared as part of the implementation of the action plan "Business Climate Transformation" in the direction of "Protection of Rights and Legitimate Interests of Business Entities".
The draft law provides that when obtaining a license, foreign legal entities should indicate the number of the entry on accreditation of a branch of a foreign legal entity in the register and the date of entry on accreditation of a branch of a foreign legal entity in the register instead of data from the Unified State Register of Legal Entities.
"Currently, the application for license shall contain the registration number of the record on the creation of a legal entity, the data of the document with the fact of entering information into the Unified State Register of Legal Entities. The foreign legal entities cannot do this, since their branches are accredited before they start operating on the territory of the Russian Federation, and not registered in the Unified State Register of Legal Entities. By amendments to law No. 99-FZ, we eliminate this gap in regulation," Alexander Vdovin explained , Director of the Department of state policy in the field of licensing, control and supervision, accreditation and self - regulation.
According to the register of accredited branches of foreign legal entities published on the official website of the Federal Tax Service of Russia, only for the period from January 1, 2015 to December 31, 2019, 2,257 branches of foreign legal entities were accredited.
Federal law No. 99-FZ applies to 52 types of licensing and about 600 thousand active licenses (as of January 1, 2020). The most widespread areas to be accredited are educational activities (120 thousand licenses), medical activities (103.5 thousand licenses), passenger transportation by road (64.8 thousand licenses) and pharmaceutical activities (55.4 thousand licenses).
